Right to compensation
Hand luggage
The carrier shall be liable for loss of or damage to items carried by the passenger, e.g. hand luggage. The passenger is entitled to compensation up to a limit of approximately €1,500 per passenger.
Checked baggage
In case of total or partial loss of checked luggage, the carrier must pay:
- If the amount of the loss or damage has been proved, compensation equal to such proved amount, not exceeding 80 units of account per kilogramme of gross weight missing or 1,200 units of account per package.
- If the amount of the loss or damage has not been proved, compensation calculated at a flat rate of 20 units of account per kilogram of the missing gross weight or 300 units of account per package.
The passenger is not entitled to this compensation when the damage or delay of the baggage is attributable to the passenger or to any of the following circumstances:
- Lack or defect of packing.
- Special nature of the luggage.
- Baggage with objects excluded from carriage.
It is important to carry your luggage correctly identified, with your name, surname and address. This way, in case of loss, it will be easier to identify it.
Time to write off luggage
A package may be considered lost if it has not been delivered or made available to the owner within 14 days of the request for delivery.
Recommendations
Before travelling:
- Baggage and hand luggage labelling.
- Take a photo of the suitcase and its contents to facilitate identification in case of loss.
- Check baggage rules. Each company sets its own rules on dimensions, number of packages, type of goods allowed on board, as well as the additional fees to be paid.
- Avoid carrying valuables in your luggage.
- If you are travelling with special luggage, e.g. musical instruments, surfboards or bicycles, please check with the railway company before purchasing your ticket.
During the trip.
- Keep an eye on luggage at stops.
In cross-border travel.
- Inform yourself at customs of the rights and obligations of travellers within the EU, particularly with regard to the quantities permitted for certain products (cigarettes, alcohol, etc.).
In case you forget your luggage on the train.
- Contact the lost property service at the terminal station.
In case of theft.
- Report the theft to the police.
- Check whether your bank card, home insurance, travel insurance, etc. cover the theft.
