The European Consumer Centre in Spain can help you:
- If you are a private consumer.
- If you live in Spain.
- If the company is headquartered in an EU country other than Spain, Iceland, Norway or the United Kingdom.
- If you have previously claimed the company in writing.
- If you have not used the legal procedure/ court procedure or you has not resorted to the consumer arbitration system.
- If it is not a case of fraud or providing redress.
Exhausted without this amicable route, they will orient consumers on other systems of Alternative Dispute Resolution and eventually the judicial route such as the European small claims.
- If your request or claim is against a Spanish company, check here the different out-of-court procedures and court procedures you may use.
- If your habitual residence is in another EU Member State, Norway or Iceland and the claim is against a company registered in Spain, you should contact the European Center in your country.
- If your complaint is related to the financial sector, insurance and pension funds, or investment services, you should address the complaint to the designated body in the country where the company is headquartered. The competent bodies in each EU country, Iceland, Liechtenstein and Norway can be found on Fin-Net.
- If your query is related to Data Protection, you should contact the AEPD.
- If the complaint is related to gambling activities (games, lotteries and bets, raffles, contests or any other game of chance) it must be sent to the competent authority: Judicial Bodies.
- If your inquiry is related to Online Security, you should contact BCIT (Brigada Central de Investigación Tecnológica de la Policía Nacional).
- If the complaint is related to fraud or crime, you should address it to the competent authority: Policía, BCIT, Guardia Civil, Ministerio Fiscal, Órganos Judiciales.
- If the inquiry is related to the claim for damages you should address it to the competent authorities: Ministerio Fiscal, Órganos Judiciales.
If you wish to lodge a complaint against a company in another EU country, Iceland, Norway or United Kingdom before addressing it to the European Consumer Center, it is necessary to complain to the company in the first instance. For this purpose, different models of specific complaint forms are provided.
