The European Commission has recently presented a new initiative that includes an advertisement and a label for all products sold in the European Union market. These new measures, which are being introduced as a result of the implementation of the European Directive on consumer empowerment for the green transition, will come into force next year and aim to facilitate the identification of more durable products and promote the transition to a circular economy.
Clearer legal guarantees and uniform labeling
The mandatory notification, which will be displayed both in physical stores and on online sales platforms, is intended to inform consumers about their legal rights in relation to product warranties. This measure will provide clear guidance on the procedures for resolving problems with non-compliant products and on the rights to free repair or replacement.
A new product label is also being introduced, which may be adopted by companies offering a longer warranty than the minimum legal warranty (three years in Spain) and covering the entire product at no additional cost to the consumer. The aim is to boost demand for more durable products with a longer useful life cycle, while providing clearer information on consumer rights.
Guaranteed rights for consumers
In accordance with legislation, in Spain, the mandatory warranty for new consumer goods was extended in 2022 from two to three years. For second-hand products purchased from a professional seller, the warranty period was also extended, so that now the buyer and seller can agree on a warranty period of between one and three years. The minimum legal warranty for tangible products with digital content or services is two years. However, it should be noted that products purchased from private individuals or at public auctions are not covered.
Next steps and implementation of the Directive
EU Member States have until March 27, 2026, to transpose this Directive into their national legislation. Once it comes into force on September 27 next year, consumers across the EU will be able to see the advertisement and the new label at points of sale.
