New edition of the ECC-Spain Newsletter

The European Consumer Centre in Spain (ECC-Spain) publishes the 26th Newsletter with the most outstanding news on Consumption in the European Union.
Nuevo número del Boletín de Noticias de CEC-España

The Newsletter includes, among other news, information on the new brochure on the European Small Claims Procedure, an alternative to court procedures in the Member States which aims to simplify, speed up and reduce procedural costs in cross-border claims in the European Union (except Denmark), for amounts up to EUR 5,000. It includes information and practical advice for consumers on how to resolve European cross-border consumer disputes through the courts in a relatively simple procedure, without the need for a lawyer or solicitor and using standardised forms that consumers can submit in their own language to the courts in their local area.

The Newsletter also includes recommendations for sustainable, safe and pet-friendly travel, as well as information on the new free train tickets for commuter and conventional medium-distance services, which can be used from 1 September to 31 December of this year. Likewise, a new sentence is analysed in which it is insisted once again that strikes by cabin crew and airline pilots are not extraordinary circumstances and, therefore, passengers affected by airline staff strikes are entitled to reimbursement of the ticket and financial compensation in accordance with European Regulation (EC) 261/2004. With regard to the charging of supplements by airlines for hand luggage, another recent sentence is also examined, which insists that airlines that charge supplements for hand luggage would be in breach of the applicable regulations since - in principle - hand luggage must be considered an indispensable element of passenger transport and its carriage cannot, therefore, be subject to a price supplement.

It is also worth highlighting the new regulations that the European institutions are working on to protect consumers, such as the rules on consumer credit or those to make the current digital environment easier and safer.
